4. Refund Eligibility

4.1 Eligible for Full Refund

Pre-project Payment: If project has not commenced (within 7 days of payment)
Service Non-delivery: If we fail to deliver agreed services due to our inability
Breach of Contract: If we materially breach the service agreement
Technical Impossibility: If project becomes technically impossible due to our oversight

4.2 Eligible for Partial Refund

Project Cancellation by Client: Refund of unused portion after deducting completed work
Mutual Termination: Pro-rated refund based on work completed
Scope Changes: Refund of payments for cancelled project components

4.3 Not Eligible for Refund

Completed Services: Work that has been delivered and accepted
Client-Requested Changes: Additional costs due to client specification changes
Third-Party Limitations: Issues caused by third-party component availability
Regulatory Changes: Changes in compliance requirements during project
Force Majeure: Delays due to circumstances beyond our control

5. Specific Refund Terms

5.1 Consultation Services

24-Hour Cancellation: Full refund if cancelled 24+ hours before scheduled consultation
Same-Day Cancellation: 50% refund if cancelled same day
No-Show: No refund for missed appointments without notice

5.2 Design Services

Concept Phase: Full refund if cancelled before design work begins
Active Development: Partial refund based on deliverables completed
Final Delivery: No refund after final deliverables are provided

5.3 Prototyping Services

Pre-Production: Refund of material costs if cancelled before component ordering
In-Production: No refund for ordered components and labor costs
Testing Phase: No refund for completed prototype testing

5.4 Long-Term Projects

Milestone-Based: Refunds calculated based on completed milestones
Monthly Retainers: Refund of unused monthly portion with 30-day notice
Annual Contracts: Pro-rated refund for unused months minus setup costs

6. Refund Process

7. Warranty and Guarantees

Professional Standards: Services performed according to industry standards
Correction Period: 30 days to address any defects in deliverables
No Performance Guarantees: We do not guarantee specific technical outcomes

7.2 Post-Delivery Support

Documentation: Complete technical documentation provided
30-Day Support: Basic support included for 30 days post-delivery
Extended Support: Available under separate agreement

8. Dispute Resolution

8.1 Internal Resolution

Direct negotiation with project manager
Escalation to company management
Mediation services if necessary

8.2 Legal Framework

Governed by Romanian consumer protection laws
EU consumer rights where applicable
Commercial disputes under Romanian commercial law

9. Special Circumstances

9.1 Technical Failure

If our solution fails to meet agreed specifications due to our error:

Full refund of related services
Compensation for reasonable additional costs
Free correction if technically feasible

9.2 Intellectual Property Issues

Refund if we cannot deliver due to IP conflicts
No refund if client-provided specifications infringe third-party rights

9.3 Regulatory Compliance

Refund if our solution fails required compliance due to our oversight
No refund for changing regulations after project completion

10. Limitations

10.1 Maximum Liability

Refunds limited to amount paid for specific services
No liability for consequential or indirect damages
No compensation for business interruption or lost profits
